Un Empleado Sufre una Lesión en la Espalda al Resbalarse y Caer de una Escalera

Aproximadamente a las 3:24 p. m. del 4 de junio de 2012, el empleado n.º 1 trabajaba como empleado de almacén y dependiente en Burlington Coat Factory, en Daly City, California. Estaba utilizando una escalera en el almacén. Una compañera de trabajo, que también era vendedora, vio al empleado n.º 1 apoyar una escalera de mano contra las estanterías del almacén para acceder a las cajas de la estantería superior. El empleado n.º 1 estaba utilizando la escalera de mano sin abrir sus patas ni activar sus barras de separación. Ella lo vio subir los peldaños. La compañera de trabajo se dio la vuelta y dio unos pasos antes de oír un estruendo cuando la escalera se cayó. Vio la escalera en el suelo y al empleado n.º 1 tumbado encima de ella. Un segundo compañero de trabajo, empleado del almacén, dijo que no vio al empleado n.º 1 colocar la escalera ni caerse con ella. Oyó un estruendo y se dio la vuelta para descubrir que la escalera se había deslizado hacia atrás. Había caído con los peldaños hacia arriba. El empleado n.º 1 yacía boca arriba sobre la escalera, con los pies hacia la estantería y la cabeza cerca de la parte inferior de la escalera. Los dos compañeros de trabajo llamaron a los servicios de emergencia y atendieron al empleado n.º 1, que había perdido el conocimiento. El empleado n.º 1 fue trasladado en ambulancia al Hospital General de San Francisco el 4 de junio de 2012. Fue dado de alta el 6 de junio de 2012. El informe indicaba que había sufrido una lesión en la espalda, pero no especificaba la naturaleza de dicha lesión. El supervisor de recepción y almacén y otros miembros de la dirección de la tienda desconocían los procedimientos de los empleados relativos al uso de la escalera antes de este incidente. Las entrevistas indican que no se impartió formación sobre el uso seguro de las escaleras a los empleados que las utilizaban, y el empleador no proporcionó documentación sobre dicha formación cuando se le solicitó. CITAS 1-1 GENERAL – T8 3276(e)(16)(C): No se garantizó que el trabajador utilizara la escalera de mano correctamente con las patas extendidas y los soportes. 1-2 GENERAL – T8 3276(f): No se garantizó la formación en seguridad en el uso de escaleras según los requisitos de esta sección. 1-3 NORMATIVO – T8 342(a): No informar de un accidente que requirió la hospitalización del trabajador durante más de 24 horas. El accidente fue informado oportunamente por el Departamento de Bomberos de Daly City. El empleador no informó del incidente.
