An operator on a landscape project experienced sneezing, shortness of breath and watery eyes immediately after burying a drum containing residue of a hazardous herbicide called 2,4-d. The court ruled that the county that ran the site had exposed the operator to hazardous chemicals but limited the fine to $5,000 given the county’s good safety record and its expression of remorse for the incident.
