En esta sección se aborda la información general relativa a la Ley de Americanos para Discapacitados del 2008.

La Ley de Americanos para Discapacitados (ADA por sus siglas en inglés) prohíbe la discriminación de los empleadores basada en la discapacidad de un empleado o de un posible empleado. Según ADA, el término “discapacidad” se define como un impedimento físico o mental que limita sustancialmente una o más de las principales actividades de la vida del individuo. No se debe considerar una medida atenuante (es decir, medicación o un dispositivo que mejore el impedimento) al determinar si un impedimento es una discapacidad. Establece claramente que un empleador no puede discriminar a una persona calificada con una discapacidad, y que se requieren “ajustes razonables” para los que están bajo la protección de ADA (a menos que hacerlo cause “dificultades indebidas” en la operación general).

A quién se aplica también

ADA se aplica a todos los empleadores privados con 15 o más empleados, a los gobiernos estatales y locales, a las agencias de empleo y a las organizaciones laborales. El reclutamiento, la contratación, las tarifas de pago, los ascensos y la selección para la capacitación de dicha empresa están sujetos a seguir el dictamen de ADA. Para la protección de ADA, un empleado o candidato debe tener una discapacidad y debe ser capaz de ejecutar las funciones esenciales del trabajo, con o sin un ajuste razonable por parte del empleador.

Adaptación razonable

Por adaptación razonable se entiende toda modificación o ajuste de un deber o entorno laboral que permita a un empleado calificado o a un posible empleado con una discapacidad participar en el proceso de solicitud de empleo, realizar las tareas esenciales de un trabajo o recibir beneficios y privilegios de empleo iguales a los que se otorgan a los empleados sin discapacidades.
