Este trabajador no pudo volver a su puesto de trabajo tras sufrir lesiones al ser abordado durante una broma. El trabajador lesionado demandó al empresario. ¿Es responsable el empleador?

Wayne Booth era un conductor de camión empleado como transportista independiente por contrato para Southern Hens Inc. en Mississippi.

El 30 de octubre de 2012, Booth fue a Southern Hens para recoger un remolque. Mientras esperaba el papeleo, el empleado de Southern Hens, Jerome Caldwell, agarró a Booth por detrás de su cintura en un “abrazo de oso”. Caldwell empujó a Booth contra unas cajas y lo empujó a través de una puerta hacia una pila de palés.

A Booth le dijeron que Caldwell “sólo estaba jugando”. Sin embargo, Booth sufrió graves lesiones en la espalda que requirieron tratamiento médico. No pudo volver al trabajo debido a las lesiones, Caldwell fue despedido como resultado del incidente.

Booth demandó a Southern Hens, alegando negligencia y falta de supervisión y control de sus empleados. Southern Hens solicitó un juicio sumario. Un tribunal de primera instancia accedió a la petición de la empresa y desestimó la demanda de Booth. Éste apeló. 

Al revisar el caso de Booth, un tribunal de apelación de Mississippi señaló que un empleador es responsable de las acciones de un empleado realizadas en el curso y alcance de su empleo. La conducta no se considera en el curso y alcance del empleo cuando no está autorizada, no sirve a los fines del empleador o es un “acto ilícito” cometido cuando un empleado “abandona” el empleo. 

El tribunal de apelación consideró que el tribunal de primera instancia había considerado correctamente que la conducta de Caldwell de abrazar a Booth y empujarlo contra una pila de paletas estaba fuera del curso y el alcance de las funciones laborales de Caldwell: cargar y descargar envíos. Dado que no está dentro del curso y el alcance del empleo de Caldwell, Southern Hens no puede ser responsable de ello, dictaminó el tribunal.

La jurisprudencia de Mississippi también dice que el propietario de un local debe proteger a un invitado de “lesiones razonablemente previsibles a manos de otro”. 

El tribunal de apelaciones consideró que las acciones de Caldwell no eran “razonablemente previsibles”. El incidente ocurrió sin previo aviso en cuestión de segundos. Caldwell no tenía un historial de tendencias peligrosas o violentas en el trabajo.

También es importante: Southern Hens tenía normas de seguridad que prohibían específicamente las peleas, las amenazas físicas a otros, las “bromas” pesadas. Los registros mostraron que Caldwell firmó una lista de comprobación en la que afirmaba que entendía que no se toleraban las bromas. 

Por lo tanto, el tribunal de apelación confirmó la decisión del tribunal de primera instancia de desestimar la demanda de Booth.
